Retailer Terms of Service.

These terms govern retailer accounts in the Luxury Enthusiast pilot, operated by Luxury Enthusiast LLC (“we,” “us,” or “our”). Paid campaigns require a separate accepted campaign order before activation.

1. Your account and authority

You confirm that you are authorized to act for the retailer identified in the account, that the information you provide is accurate, and that you will keep your account credentials secure. Account creation does not guarantee approval to advertise. We may review, reject, pause, or remove campaigns under our advertising standards and applicable law.

2. Independent perspectives

Member ratings, reviews, photographs, commentary, and community verdicts are the opinions of their authors. Buying an ad does not purchase a favorable rating, editorial coverage, moderation outcome, or control over a member’s perspective. We may moderate content under our published policies, but we do not promise to monitor all content or remove lawful criticism on a retailer’s request.

3. Public reaction and third parties

A campaign, product, review, or retailer may attract criticism, controversy, unfavorable ratings, reposts, or other discussion on Luxury Enthusiast or third-party sites and social platforms. To the extent permitted by law, we are not responsible for independent third-party speech, decisions made by social platforms, or the commercial or reputational effects of such reactions. This does not excuse our own obligations under applicable law or our express contractual commitments.

4. No promised results

We do not guarantee impressions, clicks, leads, visits, sales, revenue, positive sentiment, a particular audience, or return on advertising spend unless a signed campaign order expressly states otherwise. Performance can vary with audience interest, placement availability, budgets, creative approval, and factors outside our control. A chargeable click is defined by the applicable campaign order and click-validation rules; campaign reporting and credits are handled under that order.

5. Retailer content and compliance

You retain ownership of your creative and grant us a limited license to display, resize, and distribute it for the agreed campaign. You represent that you have the rights to submit all images, marks, and claims; that your ads, product descriptions, destinations, disclosures, inventory, prices, and offers are accurate and lawful; and that you will comply with applicable advertising, consumer-protection, intellectual-property, privacy, and endorsement rules. You are responsible for your products, services, fulfillment, refunds, customer service, and any claims you make.

6. Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Luxury Enthusiast LLC and its officers, employees, and agents from third-party claims, damages, judgments, settlements, and reasonable legal costs arising from your ads or supplied materials; your products, services, sales, or retailer conduct; your breach of these terms; your violation of law; or claims that your materials infringe another person’s rights. We will notify you reasonably promptly of a claim and cooperate in its defense at your expense. You may not settle a claim in a way that imposes an admission or ongoing obligation on us without our written consent. This obligation does not apply to the extent a claim is caused by our own unlawful conduct, gross negligence, or willful misconduct, or where law prohibits indemnity.

7. Limits of liability

To the fullest extent permitted by law, we are not liable for lost profits, expected sales, lost goodwill, reputational harm, or other indirect, incidental, special, consequential, or punitive damages arising from a campaign or retailer account, even if advised that such harm is possible. Our aggregate liability arising from an affected campaign will not exceed the amount paid to us for that campaign during the three months before the event giving rise to the claim. This limit does not apply where prohibited by law or to liability that cannot lawfully be limited, including our willful misconduct or fraud.

8. Billing and disputes

At launch, the introductory offer is a waived setup fee, $1 per eligible click, and a $100 minimum prepayment to start a campaign. Ad delivery draws down that prepaid balance for eligible clicks only. The accepted campaign order and billing policy will define eligible clicks, exclusions, credits, disputes, and any refund of unused balance before payment. A retailer may request its own click event ledger for a campaign; visitor IP addresses and private member information are not provided in that export. Nothing here limits mandatory statutory rights.

9. Changes and contact

Material changes to these terms will be shown before they apply to new paid campaigns. Retailer notices and billing questions may be sent to hello@luxuryenthusiast.com. Luxury Enthusiast LLC was formed in Arizona. Unless applicable law requires otherwise, these terms are governed by Arizona law. The accepted campaign order will provide the process and time limits for click and billing disputes.

Retailer accounts are in pilot review. No paid campaign can start until separate billing terms and payment setup are available.
